Carine van den Brink is a lawyer specialized in transactions in the life sciences. In her work she combines here over 30 years of experience as a transaction lawyer with her medical background. Carine has an in-depth knowledge of the biotech and technology markets as lawyer, in-house counsel and supervisory board member. The presentation will guide you through the legal pitfalls relating to intellectual property, particularly patents and copyright. After a general introduction, ownership, challenges and enforceability of intellectual property rights will be discussed in view of recent case law. Furthermore, legal requirements in various European countries and the US will be compared to give you a broad overview. In addition, you will learn about additional regulatory protection mechanisms such as SPCs, orphan drug act and data exclusivity and how to use them in connection with intellectual property protection.
