Use of AI in Clinical Trial Design and Optimization: Opportunities, Challenges, and IP Protection

7 October 2026 | 12:05 - 12:25

In this presentation, we explore the growing role of artificial intelligence (AI) in clinical development, with a particular focus on relations between the design and optimization of clinical trials and intellectual property.AI is increasingly being used to identify new therapeutic options or improve on therapeutic aspects in preclinical and clinical developments. At the same time, these AI-supported innovations have raised new questions regarding intellectual property (IP) protection, and the legal frameworks are evolving gradually to adapt to these AI-assisted inventions.

Through practical cases, we will explore how AI has been used to generate clinically and commercially valuable innovations, including new medical indications, patient selection strategies, and dosage regimens. We will also discuss when such innovations may be successfully protected, as well as the legal and practical challenges that can arise in securing IP rights for these developments.
